Thousands of federal student loan borrowers are receiving emails this week, notifying them of loan discharges under the Sweet v. McMahon settlement. This final group comprises post-class applicants who submitted Borrower Defense applications between June and November 2022, not attending Exhibit C schools. The agreement resolves claims of unlawfully delayed or denied Borrower Defense to Repayment applications, granting full student loan discharge, refunds, and credit adjustments. Despite issuing the notices, the Education Department is actively appealing to delay this relief, citing settlement terms and costs. Borrowers should check all email folders and update their Federal Student Aid contact information. Relief is anticipated within one year of the notice, pending the appeal’s outcome.
