Just a reminder that Trumps Dad Fred was arrested at a KKK rally in 1927. 
I’m sure the fact that Bill Barr’s son-in-law was transferred from DOJ to White House counsel’s office while Barr was overseeing Mueller Investigation had nothing to do with helping Trump, nor did Mary Daly (Barr) transfer from DOJ to FinCEN at Treasury involve Trump’s taxes.
In several of the lawsuits he filed challenging election results in the wake of the 2020 election, Trump himself said he was acting “in his personal capacity as a candidate,” as distinct from his official capacity as president.
Now, though, Trump claims that whether or not he was acting as a candidate on Jan. 6, his comments on “matters of public concern” fall within the scope of his presidential duties.
If SCOTUS decides all presidents have absolute immunity next month…and Biden shoots Trump during a debate…would that be covered?

Trump told SCOTUS in his 12/9/20 brief that he was filing in his “personal capacity as a candidate.” The Court need not resolve more difficult immunity Qs not at issue here. Rule quickly and decisively.
Trump’s lawyers also used the reverse argument at his impeachment trial in the Senate. They said he shouldn’t be impeached because he was subject to criminal prosecution if his actions warranted it.
If SCOTUS throws this back to a lower court, delaying the trial until after the election, they should be impeached.
