Nancy Pelosi Sells Out The Public: Agrees To Put Massive Copyright Reform In ‘Must Pass’ Spending Bill

But rather than actually discussing and debating those issues, and fixing the bill to make sure it is constitutional and protects the public, we’ve heard from three different sources that Nancy Pelosi has given the go-ahead in the House to include the CASE Act in the spending bill. As we said earlier this week, if you’re trying to ram through a bill by adding them to an appropriations bill, it’s because you know it has problems and will cause major issues and you just don’t care because the politics of pleasing donors is too important. Hollywood has been screaming for this bill, and Pelosi has agreed to put it in.

Copyright is the very foundation of the publishing economy and authors’ ability to earn income. It is so important to democracy that our founders put it in the Constitution.     As I am sure your aware, most authors don’t earn much from their intellectual property which can take them years to research and create, and which our country depends on not only for entertainment but also information and education.

    The Digital Millennium Copyright Act (DMCA) limits the circumvention of software that’s designed to restrict access to copyrighted works. Unfortunately, such a blanket restriction can chill competition, free speech, and fair use. In an attempt to mitigate those harms, every three years the U.S. Copyright Office holds a rulemaking proceeding to consider exemptions to this rule. EFF has participated in this rulemaking procedure for many years, and has secured exemptions for device unlocking, jailbreaking, ripping videos for remix, and more.

    In the 2021 proceeding, we’re requesting exemptions for repair, diagnosis, and modification of any software-enabled device, including everything from digital cameras and e-readers to automated litterboxes and robotic pets; and jailbreaking streaming video devices like the Roku, Apple TV, and Amazon Fire Stick (which we believe is already covered by the current exemption for jailbreaking smart TVs). We’re also requesting renewal of the existing exemptions for jailbreaking smartphones, tablets, and other all-purpose mobile computing devices, smart TVs, or voice assistant devices; and diagnosis or repair of smartphones, home appliances, or home systems.

    Over the next few months, we’ll be presenting evidence to the Copyright Office to support these exemptions. Many other organizations have filed exemption requests as well. All of these exemption proposals can be viewed on the Copyright Office website.

    I know everyone is focused on Trump’s attempt to take away Section 230 in the NDAA, but an equally important issue is that members of Congress have been trying to do Hollywood’s bidding and sneak massive copyright reform into a must-pass government appropriations bill. The CASE Act has many problems that we’ve discussed, including the fact that it would unleash a wave of copyright trolling for people accidentally or innocently sharing works they don’t realize are covered by copyright. There are also significant Constitutional problems with it, in that it routes around the Title III courts by handing disputes about private rights to the executive branch. That’s not allowed.
