Thune secures provision in government funding bill (snuck in) Letting senators sue for phone records seizure. The party of law and order has turned into the party of rewarding criminals.
The new legislative language is an escalation of the GOP’s efforts to discredit former special counsel Jack Smith.
Politico is reporting Senate Majority Leader John Thune inserted the provision, which could allow payouts of millions in taxpayer money to Republican Senators in his conference.
They got phone records…no wiretapping. It was metadata. Perfectly legal in investigations.Their phone records were subpoenaed via grand jury and their toll data was obtained. Wire tapping and toll data records are not synonymous. A grand jury subpoena was issued for the phone records of several Republican senators in 2023 as part of the special counsel’s January 6 investigation. The subpoena targeted telecommunications companies, not the senators directly, and sought call log data.
Late last night, the Senate voted 60–40 to end the shutdown. Also added was a Repub provision that will let senators sue the fed gov’t for at least $500K if their phone records are secretly seized as part of a fed investigation. A potential payday for Repubs under investigation.
THERE WAS NO VIOLATION
A subpoena is a legal method to get date, time, and number dialed information. The phone companies routinely respond to these subpoenas every day.
These republican senators are MONETIZING that their phone records were subpoenaed as part of the Jan 6 insurrection investigation. Unreal. It’s brazen corruption and self dealing. Republican Senators put a provision in the leg branch approps bill to let themselves sue for millions in taxpayer money over Jan. 6 wiretaps. If Trump’s DOJ doesn’t fight them they just get a bunch of money.

It was basic phone record data- who called what number, for how long, not call contents.
Because the provision is retroactive to 2022, it would appear to make eligible the eight
lawmakers whose phone records were subpoenaed by investigators for Mr. Smith as he examined efforts by Donald J. Trump to obstruct the results of the 2020 presidential election.
Each violation would be worth at least $500,000 in any legal claim, according to the bill language. The bill would also sharply limit the way the government could resist such a claim, taking away any government claims of qualified or sovereign immunity to fight a lawsuit over the issue.
The Republican senators whose phone records were subpoenaed as part of the investigation were:

Marsha Blackburn and Bill Hagerty of Tennessee,
Josh Hawley of Missouri,
Dan Sullivan of Alaska,
Tommy Tuberville of Alabama,
Ron Johnson of Wisconsin,
Cynthia Lummis of Wyoming
Ted Cruz (R-TX) says he is eligible
Representative Mike Kelly of Pennsylvania also had his phone records subpoenaed but would not be eligible because he is a member of the House.
