Historic ERA Equal Rights Amendment Passed
Women marched on Washington, met with Congress, and crossed the 38-state threshold to ratify the Equal Rights Amendment.
A century in the making… it is long overdue.
The Equal Rights Amendment (ERA) has “officially” been affirmed.
Things Women COULD NOT DO Before 1970:
• Have credit cards under their own name (if married)
• Lease property in their name
• Attend military academies
• Be astronauts
• Serve on juries in all states
• Receive any paid maternity leave
• Serve as the CEO of a Fortune 500 company
• Adopt a baby as a single person
• Wear pants to school in many states

Guarantees All Americans Equal Rights and Protections Under the Law Regardless of Their Sex
Equal Rights Amendment (ERA) as the 28th Amendment to the U.S. Constitution: “Equality of rights under the law shall not be denied or abridged by the United States or by any State on account of sex.”
Biden: Today I’m affirming what I have long believed and what three-fourths of the states have ratified: The 28th Amendment is the law of the land, guaranteeing all Americans equal rights and protections under the law regardless of their sex.
It only took 100+ years but the ERA is now officially the 28th Amendment of the Constitution. Virginia the final state required for passage; and finally, today, see it in our Constitution where it belongs.
In a statement, Biden said Virginia’s 2020 vote means that enough states have ratified the law. This move will likely begin the legal debate over whether it is official and can be considered law. Congress had set a timeline for ratification, and Virginia’s ratification was after that deadline.
“The American Bar Association (ABA) has recognized that the Equal Rights Amendment has cleared all necessary hurdles to be formally added to the Constitution as the 28th Amendment. I agree with the ABA and with leading legal constitutional scholars that the Equal Rights Amendment has become part of our Constitution,” Biden said in a statement.
Biden is forcing Republicans to argue women don’t deserve equal rights publicly.
Trump and MAGA will have to explain why they want to keep women downtrodden and oppose ERA amendment.
Per Laurence Tribe: It is not necessary for the National Archivist to publish the ERA in order for it to be adopted according to the provisions of the Constitution. The President avoided triggering a clash with the Archivist, who recently announced her intention to defy her statutory, and purely ministerial, duty to publish the ERA.
The only reason Congress gave the Archivist such a duty nearly a century
ago was to ensure that the Nation got word that an amendment was in force, enabling officials at all levels of government to conform their actions to it. In our modern age of broadcast, cable and internet communication, the President’s announcement itself performed that function.
