Luigi Mangione was supposed to be in Manhattan state court on Tuesday, but because he’s being held in a federal jail, prosecutors had to file paperwork or a writ requesting that he be brought over for the hearing. According to the judge, that paperwork was drafted but apparently never officially submitted by prosecutors, so Mangione was never transported to court.
It’s not enough for a defendant to be available, or for a hearing to be on the calendar. When someone is held under another authority, the proper formal step is required before he can be brought before the judge.
Today, according to courtroom reporting, Luigi Mangione was available at 9 a.m., the Court was ready, the press was present, the public had been admitted, in unusually high numbers according to @lorenaoneil and the defense was there. Yet the required step to bring him physically into court was not in order.
In a case of this magnitude, it is hard to treat that as a mere administrative stumble.
