Trump ‘incited’ Jan. 6 riots.

Judge Sarah Wallace rules Trump ‘incited’ Jan. 6 riots.

Trump Engaged in Insurrection but Can Stay on Colorado’s Ballot Anyway

Court Rules cause Wallace found that, while Trump did incite an insurrection, he did not meet the qualification of “an officer of the United States,” meaning he can still appear on the ballot.

WHAT TOTAL BULLSHIT WEASEL WORDS

Because of “the absence of the … oath is one to ‘support’ the Constitution whereas the presidential oath is to ‘preserve, protect and defend’ the Constitution,” Judge Wallace wrote, “i
The “commander in chief,” the guy with the nuclear codes is not an “officer?”

What? How is the President NOT an officer of the US?
This is LUDICROUS.

The article says that because “the president” was not specifically named in the 14th Amendment, “the president” does not meet the qualification of “an officer of the United States.”

First, to the question whether the president is an officer: Does the Constitution actually define what is an “officer”? Or is it, as reason would suggest, “one who holds an office”? Following excerpt from the Constitution seems to suggest that the president just might be an “officer”:

From U.S. Constitution:

Article. II.Section. 1.The executive Power shall be vested in a President of the United States of America. He shall hold his Office during the Term of four Years

No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States. In Case of the Removal of the President from Office, or of his Death, Resignation, or Inability to discharge the Powers and Duties of the said Office, the Same shall devolve on the Vice President, and the Congress may by Law provide for the Case of Removal, Death, Resignation or Inability, both of the President and Vice President, declaring what Officer shall then act as President, and such Officer shall act accordingly, until the Disability be removed, or a President shall be elected…. Before he enter on the Execution of his Office, he shall take the following Oath or Affirmation:—”I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.”

Next, as to the 14th Amendment:

14th Amendment:

Section 3. No person shall be a Senator or Representative in Congress, or elector of President and Vice President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may, by a vote of two-thirds of each House, remove such disability.

Is it at all reasonable, to a reasonable person, to interpret the absence of the word “president” in the foregoing to mean that the president is uniquely allowed to engage in insurrection??

America is crumbling. Founded as “A nation of laws, not of men” [John Adams], we have been profoundly forsaken by men and those who apply and interpret the law.

TRFuck trump and all those who support him.
