The Supreme Court has not said “no” to an imperial presidency;
rather, multiple sources indicate that its July 1, 2024 ruling in Trump v. United States significantly expanded presidential immunity, effectively endorsing a more powerful, less accountable executive branch.
The 6-3 decision held that a president has absolute immunity for “core constitutional powers” and at least presumptive immunity for all official acts, even when undertaken for personal or corrupt purposes.
While the Court maintained that unofficial acts remain prosecutable, the distinction between official and unofficial conduct is left to lower courts, creating significant ambiguity.
