“No blaming it on his spouse”: Critics say seditious Alito flags expose his “Christian nationalism”
When Supreme Court Justice Samuel Alito was caught raising an upside down American flag outside his Virginia home, the conservative jurist found a woman to blame: his wife. It was she who decided to wave the chosen banner of election deniers in the wake of the January 6 insurrection, he said, after she became righteously furious at an allegedly profane display of anti-Trump sentiment in her neighborhood. Alito, innocent, just happened to live there — with no input on the seditious décor.
Everything about this is normal, okay?
It took just over a week for The New York Times to find out there was another flag, at another home, also associated with the fringes of the American right. This one, known as the “Appeal to Heaven” flag for the words printed on it, above a depiction of a pine tree, was displayed outside Alito’s beach house in New Jersey during the summer of 2023.
This time Alito did not blame his wife; per the Times, he had nothing to say at all.

Garland calls Trump’s false FBI search claim ‘extremely dangerous’
Attorney General Merrick Garland said former President Trump’s false claim about the FBI being ready to kill him in their Mar-a-Lago search is “extremely dangerous” in recent comments.
Trump falsely claimed in a fundraising email Wednesday that President Biden was “locked & loaded and ready to take me out,” another attack about the classified records found at his estate. His email claimed Biden or the Justice Department was “authorized to shoot” Trump.
Garland disputed the accusation in a press briefing Thursday.
“That allegation is false, and it is extremely dangerous,” Garland said. “The document that has been referred to in the allegation is the Justice Department standard policy, limiting the use of force.”
“As the FBI advises, it is part of the standard operations plan for searches and in fact, it was even used in the consensual search of President Biden’s home,” he continued.
The statement on law enforcement protocol Trump refers to in his email allows the use of deadly force “only when necessary” when someone “poses an imminent danger of death or serious physical injury” to an officer or another person.

Clarence Thomas Is a Big Fan of Racial Gerrymandering
In a Supreme Court decision siding with South Carolina Republicans, the right-wing justice took the opportunity to attack landmark civil rights rulings that protected Black voters’ political representation.
The Supreme Court just made it far more difficult to challenge racial gerrymandering by state legislatures. In a 6–3 decision on Thursday that fell along the usual lines, the justices rejected a challenge to a district that was redrawn to favor Republican candidates. But one right-wing justice took the opportunity to go even further, suggesting that the federal courts, including the high court, should not even consider gerrymandering cases in the future. That would have disastrous consequences for Black voters in the South.
Justice Samuel Alito, writing for the court, concluded that the plaintiffs challenging one of South Carolina’s congressional districts had failed to show that the changes were racial in nature instead of partisan. “When partisanship and race correlate, it naturally follows that a map that has been gerrymandered to achieve a partisan end can look very similar to a racially gerrymandered map,” he wrote in Alexander v. South Carolina State Conference of the NAACP.
A far more ominous opinion came from Justice Clarence Thomas. While he largely agreed with Alito’s conclusions, he also wrote a separate concurring opinion “to address whether our voting-rights precedents are faithful to the Constitution.” In it, he suggested that federal courts should not hear racial gerrymandering cases at all, whether they be claims of outright racial gerrymandering or claims of vote dilution.

The flag’s close association with both far-right Christian nationalists and the insurrectionists who stormed the Capitol on Jan. 6 raises serious questions about Alito’s ability to rule impartially. The conservative court on which Alito sits is largely the product of right-wing dark-money overlord Leonard Leo, and — wouldn’t you know it — Leo flew the same “Appeal to Heaven” flag outside of his house in Maine.
Murray Ngoima, a Bar Harbor resident, provided Rolling Stone with a photo she took of the flag hanging outside of his house on Feb. 25. Ngoima says that residents were outside Leo’s house that day to protest the Alabama Supreme Court’s decision declaring that IVF embryos are people under the law. The New Apostolic Reformation is responsible for the “Appeal to Heaven” flag’s recent prominence in far-right Christian nationalist circles — which overlap with the MAGA movement. New Apostolic Reformation leaders were early to endorse him ahead of the 2016 election, and “Appeal to Heaven” flags were spotted at the U.S. Capitol during the Jan. 6 riot. The Times reported last week that Alito flew an upside-down American flag — a symbol of solidarity with the “Stop the Steal” movement — outside of his house ahead of President Biden’s inauguration.
