Trump’s Special Master brief relies on US v Nixon 418 US 683 at 782. Problem is the opinion ends at 716. The “presumptive privilege” they clam does not exist. They stopped reading! US v Nixon does not say all presidential records are privileged — a smoke and mirrors argument!
This is not to say that Magistrate Judge Reinhardt cannot use his inherent equitable powers and make the requested appointment. A Special Master would arrive at same place as DOJ/FBI! This will not help Trump!

For folks not familiar w/ legal filings, the ‘at 782’ is a reference cite in Trump’s filing. It supposed to tell the court that the argument made is supported on page ‘782’ of the ‘US v Nixon’ decision. As John notes, the Nixon case ends at page ‘716’. There is no page ‘782’.

Pro se. You get what you pay for. This is simply too funny!!!! Go to page 782 judge… oops it doesn’t exist! It ends at page 716!

They miscite it because the don’t believe what judges in Westlaw age have said, “if you lie/miscite law/facts in your papers, I’ll catch you and your reputation with judges in this district & circuit is gone. And it will never come back”.

The privilege lies with the current president, and anyway executive branch docs can’t be privileged from the executive branch.

They just want the appearance that what they are doing is being thwarted by the “deep state” or whatever bull$hit they can muster to use as chicken feed for the base…and it’ll work because the base dumb as dog$hit…
